IDEA FESTIVAL/GEEK SQUAD CHALLENGE “WHAT’S YOUR BIG IDEA?”
CONTEST OFFICIAL RULES
1. NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING. Open and offered only to legal residents of the 50 United States and District of Columbia who are 18 years or older at the time of entry. Employees and directors of Best Buy Stores, L.P. (“Sponsor”), Idea Festival (“Promotional Participant”), Archway Marketing Services (“Administrator”), and their parent entities, subsidiaries and affiliated companies, advertising, promotion, and production agencies, any companies who are performing work in Best Buy stores at Best Buy’s request, Web masters and Web suppliers (and each of their respective IRS dependents, immediate family members [children, spouse, parents, siblings] and individuals residing in their same household) are not eligible to participate. Void where prohibited by law. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Contest. Contest begins on July 23, 2007 and ends on August 13, 2007 (“Contest Period”).
2. HOW TO ENTER: Visit www.geeksquad.com/ideafestival (“Web site”) from 12:00:01p.m. Central Time (“CT”) on July 23, 2007 through 11:59:59 a.m. CT on August 13, 2007, and follow the entry instructions for submitting your idea into the “Idea Pond” in accordance with the online instructions (your “Submission”). Entrants will submit their sustainable solution for solving one of the following three (3) challenge categories (each a “Category”): 1) Solutions for e-waste; 2) Power conservation; or 3) Maximizing untapped resources. Your Submission may also include photographs and/or video. Submissions must be received by 11:59:59 a.m. CT on August 13, 2007 to be eligible. Sponsor’s computer will be the official time clock for the Contest. You may enter as often as you wish, but each Submission must be separate and unique (no duplicates). If any group of individuals elects to collaborate on a Submission, they are required to designate one individual to enter the Contest and accept the prize on behalf of the group. Sponsor is not liable for any disputes between collaborators related to a Submission. Any attempt by any person to obtain more than the stated number of entries by using multiple/different email accounts or any other methods will void all of that person’s entries and that person will be disqualified. Sponsor is not responsible for lost, late, or incomplete entries, entries not submitted in accordance with the instructions, or entries not received for any reason.
3. CONTEST REQUIREMENTS: To be eligible, your Submission must: (1) be submitted in accordance with the online instructions and meet these Contest Requirements; (2) not exceed 15 MB in size; (3) if submitting a video, must not exceed sixty (60) seconds in length and must be in .wmv, .mov, .avi, .mpg, .mpeg, .mp4, .asf, .3gp or a .3g2 format; and
(4) not infringe on any other person’s or entity’s rights (collectively, a “Qualifying Submission”). The uploading process is designed to work with most digital cameras, camcorders and cell phones in the above formats, but Sponsor makes no guarantee that any particular device will upload successfully. Successfully submitting your Submission to the Web site is not verification that the Submission is a Qualifying Submission. Submissions that do not comply with these Official Rules or that otherwise contain prohibited, inappropriate, offensive, infringing or otherwise unacceptable content as determined by the Sponsor, in its sole discretion, may be disqualified and may not be considered for a prize.
By submitting a Submission, you warrant and represent that: (a) it is your original work and has been legally created, (b) it has not been previously published or distributed in any media, (c) it has not been entered in or won previous contests or awards, (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (e) that you have obtain permission from any person whose name, likeness or voice is used in the Submission; (f) you own all rights to your Submission, including without limitation the copyrights in the recording and the performance contained therein; (g) publication of the Submission via various media including Web posting, will not infringe on any third party rights; and (h) you will indemnify and hold harmless Sponsor, Promotional Participant and Administrator, their parent entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies, and all of their respective officers, directors, employees, representatives and agents, from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your Submission, or your conduct in creating your Submission or otherwise in connection with this Contest. If your Submission includes likenesses of third parties (such as, but not limited to, names, voices or images of persons) or contains elements not owned by you (such as, but not limited to, depictions of buildings, products, trademarks or logos of third party companies), you must be able to provide legal releases for such use, including Sponsor’s use of such entry, in a form satisfactory to Sponsor, upon request, prior to award of prize and/or naming you as a Finalist. If any likeness is of a minor, such release must include written permission from the minor's parent or legal guardian authorizing the use of the minor's likeness on behalf of the minor.
Any elements in your Submission, including without limitation music, audio, speech/voiceovers, stills, video, supers, or other audiovisual materials used, must be (a) entirely original, created and performed by you or (b) be in the public domain, Use of any elements, including without limitation music, audio, speech/voiceovers, video, stills, visuals, or other materials that are not original or in the public domain may result in disqualification of your Submission, in Sponsor's sole discretion.
By submitting a Submission, entrant irrevocably grants Sponsor and its agents an unlimited, worldwide, perpetual, unconditional, gratis license and right to publish, broadcast, reproduce, encode, store, copy, transmit, post, edit, modify, publicly display, publicly perform, adapt, exhibit, and/or otherwise use or reuse (without limitation as to when or to the number of times used) the Submission (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion) in any way, in any and all media (including but not limited to the Contest Website), without limitation, without consideration to the entrant, and without notice, review or approval from entrant or any other party. Furthermore, although Sponsor is not under any legal or contractual obligation to do so, Sponsor reserves the right to review and/or edit any and all Submission elements deemed by Sponsor, in its sole discretion, to be prohibited, inappropriate, offensive, infringing or otherwise unacceptable. Should Sponsor edit any such Submission elements, you are not relieved from responsibility for compliance with these Official Rules.
You acknowledge that, by entering your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.
Sponsor reserves the right to, but is not obligated to, monitor/screen entries prior to posting them to the Contest Website. By entering, you acknowledge that Sponsor has no obligation to use or post any Submission you submit.
Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants.
4. Contest Judging: Each eligible Qualifying Submission will be posted between July 23, 2007 and August 13, 2007 on the Web site at www.geeksquad.com/ideafestival ("Public Rating Period"). During this time the general public will be able to rate their favorite Submission, based upon personal preference and subject matter. Limit one rated Submission per Category per person per day. Any attempt by entrants or Finalists and/or their family/friends to vote more than the number of times authorized herein using multiple names or email addresses and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify the entrant/Finalist in its sole discretion. The top ten (10) Submissions in each Category to receive the most and highest number of ratings during the Public Rating Period by the general public will be deemed the finalists ("Finalist(s)"). In the event of a tie, the tying Submissions will be judged by the panel of qualified judges based on the Judging Criteria below, and the entrant with the highest score will be deemed the Finalist. No more than thirty (30) Finalists will be selected. However, in the event there are less than ten (10) eligible Submissions in any given Category, there may be less than thirty (30) Finalists, at Sponsor’s sole discretion. After the Finalists have been determined, a panel of qualified judges will then review the Finalists’ Submissions, and select one (1) Grand Prize winner for each Category
, based upon the judging criteria set forth below for a total of three (3) Grand Prize winners. All Grand Prize winners will be subject to verification and must meet all Submission and eligibility requirements and completion of all required documentation (described in Rule 7 below) in order to be confirmed as winners. Decisions of judges will be final and binding in all matters related to this Contest.
By accepting a prize, the winner agrees that its Submission will be deemed a Work Made For Hire under the Copyright laws of the United States and Sponsor will be considered the owner of the Submission. To the extent the Submission is not deemed to be a Work Made for Hire, then the winner agrees to assign and transfer to Sponsor all of his/her right, title and interest in and to his/her Submission, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have to their Submission. Sponsor reserves the right to edit/modify the winning Entry, in its sole discretion. Accordingly, winner agrees to sign all legal forms deemed necessary by Sponsor to establish Sponsor’s ownership of the right, title and interest in and to the Submission and of the transferred copyrights and “Moral Rights of Authors” waived under these Official Rules. All completed forms must be returned to Sponsor within 5 days of date notice was sent or Finalist status will be forfeited and an alternate Finalist may be selected. Further, Sponsor may request from winner, that the winner secure from any model(s) or videographer an irrevocable assignment and transfer to Sponsor all of any model(s) or videographer’s right, title and interest in and to the winner’s Entry, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. The model(s) or videographer may be required to waive in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that the model(s) or videographer may now or later have in the Entry. Should Sponsor fail to request the said model(s) assignment or videographer assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment(s).
5. Contest Judging Criteria: The Finalists’ Submissions will be judged by a qualified judging panel on or about August 15, 2007, based on the following judging criteria and percentages: creativity and originality (33.3%); usefulness (33.3%); and how well the Submission promotes social, economic and environmental sustainability (33.4%). The Finalist with the highest overall score in each Category will be deemed the Grand Prize winner for that Category. In the event of a tie between any two Finalists within a Category, the Finalist with the highest score in the promoting social, economic and environmental sustainability area will be deemed the Grand Prize winner for that Category. Sponsor will notify the winners on or about August 17, 2007.
6. PRIZES: Nine (9) Grand Prizes (Three (3) Grand Prize winners per Category): A 5-day/4-night trip for two (2) to the Idea Festival in Louisville, KY, September 12, 2007 through September 16th. Trip consists of roundtrip coach air transportation (from major airport nearest the winner’s residence) to Louisville, KY; four (4) nights hotel accommodations (standard room, double occupancy); tickets to attend the Idea Festival and ground transportation to and from the airport. All expenses not stated in these Official Rules, including meals, gratuities and incidental hotel expenses, are solely the responsibility of the winner. Travel and accommodations are subject to change and availability, and restrictions may apply. Travel must take place on dates specified by Sponsor. Winner and winner’s travel companion must travel on the same itinerary. If winner cannot take the trip as stated, prize will be forfeited in its entirety and may be awarded to an alternate winner, provided sufficient time remains to verify alternate winner and ticket prize, otherwise prize will not be awarded. Approximate Retail Value (ARV) $4,000.00/each. Actual retail value depends on the city of departure and dates/times of travel, and any difference between actual costs and ARV will not be awarded. All taxes on prizes are solely the winner’s responsibility. No responsibility is assumed for any cancellation or rescheduling of the Idea Festival, in whole or in part. In the event that the Idea Festival is cancelled or postponed for any reason, awarding of the remaining elements of prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no substitute or additional compensation will be awarded. . Total ARV of all prizes is $36,000.00. Winners may not substitute, assign or transfer prizes, or redeem prizes for cash, but Sponsor reserves the right to substitute prize with a prize of equal or greater value should the advertised prize become unavailable for any reason. Prizes will not be fulfilled outside the 50 U.S./D.C. Should a prize be won by an eligible minor in his/her jurisdiction of primary residence, all affidavits, releases and undertakings, set forth in these Official Rules must be executed and undertaken by the parent/legal guardian of the eligible minor, both on behalf of themselves and the eligible minor, or the prize will be forfeited and awarded to an alternate winner. Prizes may be awarded to, or in the name of, minor’s parent/legal guardian. If winner or guest is a minor, a parent or legal guardian must accompany him/her on trip and sign and return all required documentation. Guest of Grand Prize winner will be required to sign and return liability/publicity release prior to ticketing of prize.
7. CONDITIONS OF PARTICIPATION: Participants agree (a) that Sponsor, Promotional Participant, and each of their respective parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Contest or any Contest related activity; or for any printing, production, typographical, human, or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winners grant (and agree to confirm they grant in writing) permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, without notice, review or approval. Prize winners may be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, Copyright Assignment, and where lawful, a Publicity Release within 14 days of first attempted notification. Finalists may also be required to obtain signed publicity releases from all identifiable individuals featured in their Submissions. Sponsor reserves the right to require Finalists to submit to a confidential background check to confirm eligibility as a condition of awarding the prize to help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor or Administrator into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsor in its sole discretion. If documents are not returned on a timely basis, or if prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and may be awarded to an alternate winner. By participating in this Contest, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information pursuant to the Geek Squad privacy policy available on-line at www.geeksquad.com/faq.aspx?id=811 or by calling 1-800-GEEK SQUAD.
8.LIMITATIONS ON LIABILITY: Neither Sponsor, Promotional Participant, nor their respective agencies are responsible for illegible, lost, late, damaged, incomplete, unintelligible, non-delivered, misdirected, or stolen entries, or prize redemption forms; or for lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), Web site, telephone, or other connections, availability or accessibility; or for miscommunications, failed computer, telephone, satellite, or cable transmissions, lines, or technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, mechanical, electronic or network; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Contest or Web site, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant’s eligibility. Entries generated by a robotic, programmed, script, macro or other automated means will be disqualified. Neither Sponsor nor its agencies are responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the Web site. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend or terminate the Contest, and select Finalists and/or winners from Qualifying Submissions received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Without limiting the release provided above, and for greater certainty, Sponsor and its agencies will not be liable for (a) any incomplete or inaccurate information, whether caused by wireless device users, site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, or by any error, interruption, deletion, defect, delay in operation or transmission, communications line failure, or technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized use of or access to, or alteration of, entries; (c) any problems with or technical malfunctions of telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any Web site or combination thereof; or (e) damage to a participant’s or other person’s system or equipment occasioned by participation in this Sweepstakes. In the event of a dispute regarding the identity of an entrant, the authorized account subscriber of the e-mail address provided at time of entry, as indicated by Sponsor’s records, will be deemed the winner and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. The potential winner may be required to show proof of being the authorized account subscriber.
IN NO EVENT WILL SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.GEEKSQUAD.COM, WWW.BESTBUY.COM, OR ANY OTHER WEB SITE ASSOCIATED WITH THIS CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 9. GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of Minnesota, without regard to conflicts of law. All suits or claims brought in connection with this Contest must be brought in a state or federal court in Minneapolis, Minnesota.
